1. General terms and conditions

  1. These terms and conditions of sale and delivery apply to the purchase of items on www.littletivoli.dk.
  2. www.littletivoli.dk is owned and operated by Tivoli A/S, CVR no. 10404916, Vesterbrogade 3, 1630 Copenhagen V, telephone +45 3315 1001, e-mail little@tivoli.dk.
  3. Agreements are entered into in Danish.
  4. The right of cancellation applies only to private consumers shopping via www.littletivoli.dk. The right of cancellation does not apply to commercial operators. 
  5. Conditions for the purchase of alcohol
    You must be at least 18 years old to buy alcohol over 16.5 per mille
    You must be at least 16 years old to buy alcohol over 1.2 per mille

2. Payment and delivery

  1. We accept payment via Visa, MasterCard and MobilePay.
  2. The amount is only charged when the item is sent. 
  3. Prices are stated in Danish kroner. Payment fees may be imposed depending on the chosen form of payment. 
  4. The delivery charge is in addition to the price. Select your preferred delivery option at the end of the ordering process.
  5. We deliver the item 5–7 working days after your purchase unless otherwise specified.
  6. Items are delivered via UPS and GLS. 
  7. We offer worldwide delivery. Click here to see the list of countries we deliver to. The delivery company can charge for customs outside of EU, this is not included in the price for the delivery.
  8. If you make use of a free delivery offer, we reserve the right to choose the form of delivery, e.g. delivery to the nearest parcel facility. 
  9. We accept no liability for sold-out or discontinued items.

3. Right of cancellation

  1. You have the right to cancel an agreement without giving a reason within 14 days. If you have purchased several products in an order, you are entitled to cancel the purchase of some or all items. 
  2. The cancellation deadline expires 14 days after the date on which you, or another person chosen by you (although not the carrier), have or has physical possession of the item.
  3. If your order included several items and we are unable to deliver the items at the same time, the cancellation deadline runs until you, or another person chosen by you (although not the carrier), have or has physical possession of the last item. 
  4. If the deadline expires on a public holiday, Saturday, Constitution Day, Christmas Eve or New Year's Eve, the deadline is extended until the following working day.
  5. You may lose your right of cancellation if you break the seal on sealed products, such as creams, soaps, cosmetics and the like.

4. Returning items and return costs

  1. To cancel, please notify us by e-mailing us at little@tivoli.dk and attach a copy to the return package. You can also use the standard form under the Danish Consumer Agreements Act, which is available at the bottom of these Terms and Conditions of Sale, or Little Tivoli's own cancellation and complaints form, which can be downloaded here. The cancellation form should be sent to little@tivoli.dk. We will confirm receipt of your cancellation immediately via e-mail.
  2. You cannot cancel by refusing to receive the item or failing to collect it without also notifying us that you are cancelling. 
  3. The cancellation deadline is met if you notify us that you are cancelling the purchase before the cancellation deadline expires.
  4. If you have cancelled the purchase of an item, you must send the item to the address specified on your order confirmation, without undue delay and no later than 14 days after you have informed us that you wish to cancel your purchase. The deadline is met if you return the items before the end of the 14 days. Items cannot be posted cash on delivery and must be delivered to the door. You are responsible for paying the return fee. 

5. Repayment of funds upon cancellation

  1. When you cancel, we will refund the price of the item and the delivery costs. If you have purchased multiple items in an order and only cancel part of your purchase, the delivery costs will not be refunded.
  2. We will repay the amount without undue delay, and in all circumstances no later than 14 days after the date on which we receive your notice of cancellation. However, we may withhold the repayment until we receive the returned items, or until you forward documentation that the items have been returned. 
  3. We will make such repayments via the same payment mechanism that you used for the original transaction unless you have explicitly consented otherwise. Under no circumstances will you incur any form of fees as a result of the repayment.

6. Testing the item and packaging 

  1. You are only liable for any deterioration in the value of the item which is due to the item being handled in any way other than that which is necessary in order to determine the item's nature, qualities and the way it works.
  2. You are free to investigate the item as you can and should in an actual store, but you must not start using it. If you have used it in a way that you cannot or should not in an actual store, and we cannot resell it, or cannot resell it at full price, you should expect us to deduct this deterioration in value from the amount we repay to you. If the item no longer has commercial value, we will not refund the purchase amount. 

  3. You should also ensure that the item is securely packaged when you return it. You are liable for the parcel/the items until we receive it/them. You should therefore keep the certificate of posting and any track and trace number.

7. To complete orders in the online shop

  1. Digital products:

    When you shop in Tivoli's online shops, we will ask for your e-mail address in order to send you a receipt for your purchase. Your credit card details are processed in accordance with applicable PCI – DSS standards.
     

  2. Physical products:

    When you shop in Tivoli’s online shops, we will ask you for your e-mail address in order to send you a receipt for your purchase and your first name, surname and address to send you the products. We will also ask for your phone-number in order for you to track your order via PostNord.

8. Claims

  1. Under the Sale of Goods Act, consumers are protected for 24 months. This means that if the item has a deficiency and you claim in a timely manner, you are entitled, in the first instance, to have the item repaired or replaced. If this is not possible, or does not happen within reasonable time, depending on the circumstances, you can get your money back or a rebate on the price. 
  2. A "deficiency" refers to a matter such as a manufacturer or material fault, or incorrect information about the item. General wear and tear or damage that you have caused to the item are not deficiencies. 
  3. If you identify a deficiency, you must claim from us within reasonable time. We recommend that you claim as quickly as possible, particularly if items have been damaged in transit. If you claim within two months of identifying the deficiency, however, this is still within reasonable time. If the claim is justified, we will refund reasonable and necessary delivery costs. 
  4. If you feel that the item has a deficiency, please inform us of what the problem is in as much detail as possible. You can use our cancellation and complaints form, which can be downloaded here. This is not a requirement, but it makes it easier for us to locate the error and minimises the time taken to process the claim.
  5. Remember that the item must always be posted in secure packaging, and you must obtain a certificate of posting. Save the certificate of posting, including information about delivery costs, and any track and trace number.

9. Making a complaint

  1. Complaints about an item purchased from www.littletivoli.dk can be submitted via the contact button on the website.
  2. You can also send your complaint to the Danish Competition and Consumer Authority's Complaints Settlement Centre, Carl Jacobsens Vej 35, 2500 Valby, www.forbrug.dk.
  3. You can also send your complaint to us via the Online Dispute Resolution platform, http://ec.europa.eu/consumers/odr/, which is provided by the European Commission. This is particularly relevant for consumers who live in another EU country. When submitting a complaint, please provide our e-mail address: little@tivoli.dk

In order for you to enter into an agreement with us and shop at www.littletivoli.dk, we need the following information about you:

  • Name
  • Address
  • Phone number
  • Email address
  • Information about what you have purchased

    We process your personal data for the purpose of being able to deliver the product to you and to be able to process inquiries regarding your purchase.
